Who Is Liable for a Workplace Accident in Texas?
Texas is the only state that does not require employers to carry workers’ compensation insurance (with some exceptions). This means that, unless your employer has elected to voluntarily purchase workers’ compensation insurance, you are not covered.
If you are not covered by workers’ compensation insurance, you may be able to bring a personal injury lawsuit against an employer or another liable party if you can prove:
- You were injured and suffered damages
- The defendant owed you a duty of care
- The defendant failed to uphold the duty of care
- Your injuries and damages were the result of the defendant’s negligence or misconduct

Who Is Covered by Workers’ Comp in Texas?
Most private employers in Texas are not required to carry workers’ compensation. This means that you are only covered by workers’ compensation if your employer has voluntarily chosen to purchase workers’ compensation insurance, and you are a covered employee. However, there are some exceptions.
Public entities must provide workers’ compensation insurance for public employees, and private employers who contract with public entities may also be required to cover employees. This includes contractors working for public employers, as well as most city, county, and state employees.
