Who Is Liable for a Workplace Accident in Texas?

Texas is the only state that does not require employers to carry workers’ compensation insurance (with some exceptions). This means that, unless your employer has elected to voluntarily purchase workers’ compensation insurance, you are not covered.

If you are not covered by workers’ compensation insurance, you may be able to bring a personal injury lawsuit against an employer or another liable party if you can prove:

  • The defendant failed to uphold the duty of care

Who Is Covered by Workers’ Comp in Texas?
